3. SMS/Text Messaging Services

3.1 SMS Service Description

After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

3.7 Carrier Liability

Carriers are not liable for delayed or undelivered messages. We are not responsible for technical delays or failures in message delivery caused by your mobile carrier or device.

Our SMS service is available on all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and others. If you experience issues with your specific carrier, please contact us for assistance.

3.9 A2P 10DLC Compliance

MADS Freedom Collective operates in full compliance with A2P (Application-to-Person) 10DLC messaging standards and carrier requirements. Our text messaging service is registered with The Campaign Registry (TCR) and adheres to all industry regulations for business-to-consumer communications.

3.10 TCPA Compliance

We comply with the Telephone Consumer Protection Act (TCPA) and all related regulations. We will never:

-Send text messages without your prior express written consent

-Use an automatic telephone dialing system (ATDS) without proper consent

-Continue sending messages after you opt out

-Send messages to phone numbers on the National Do Not Call Registry (except as permitted for existing business relationships)

4. Service Agreement and Client Responsibilities

4.1 Service Scope

Services provided by MADS Collective are defined in your specific service agreement or proposal. You agree to provide accurate information about your business, brand guidelines, and content preferences to enable us to deliver quality services.

4.2 Content Approval

While we strive to create content that aligns with your brand, you retain final approval over content posted to your social media accounts. You are responsible for reviewing and approving content in a timely manner as outlined in your service agreement.

4.3 Access and Credentials

You agree to provide MADS Collective with necessary access to your social media accounts and related platforms. You are responsible for maintaining the security of your accounts and immediately notifying us of any unauthorized access.

5. Intellectual Property

5.1 Client Content

You retain all rights to your existing brand materials, logos, and proprietary content. By engaging our services, you grant MADS Collective a limited license to use your brand materials solely for the purpose of delivering our services.

5.2 MADS Content

All original content, strategies, and materials created by MADS Collective in the course of providing services become your property upon full payment. However, MADS retains the right to use general strategies, techniques, and non-confidential deliverables in our portfolio and for other clients.

5.3 Third-Party Content

If we use stock photos, graphics, or other third-party materials in your content, appropriate licenses will be obtained. You are responsible for providing rights to any content you supply for use in social media posts.

6. Payment Terms

6.1 Fees and Billing

Service fees are outlined in your specific service agreement. Payment terms, frequency, and methods are established at the time of engagement. Late payments may result in service suspension or termination.

6.2 Refunds

Refund policies are outlined in your service agreement. Generally, services are non-refundable once work has commenced due to the nature of time-based deliverables.

7. Term and Termination

7.1 Service Period

Services continue for the period outlined in your agreement. Either party may terminate services with 30 days written notice unless otherwise specified in your service agreement.

7.2 Effect of Termination

Upon termination, we will provide you with all completed work and transfer account access. You remain responsible for payment of services rendered up to the termination date.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using our services, you also consent to our Privacy Policy.

To the fullest extent permitted by law, MADS Collective's total liability to you for any claims arising from our services shall not exceed the amount you paid us in the three months prior to the claim.

10. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

-Services will be uninterrupted or error-free

-Results will meet your expectations

-All errors will be corrected

-Social media platforms will remain available or unchanged

11. Indemnification

You agree to indemnify and hold harmless MADS Freedom Collective, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

-Your breach of these Terms and Conditions

-Your violation of any law or third-party rights

-Content you provide that infringes intellectual property rights

-Your use of social media platforms

12. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of our business relationship. This includes business strategies, unpublished content, financial information, and other sensitive materials.

13. Changes to Terms

We may update these Terms and Conditions from time to time. Any changes will be posted on our website at lander.madscollective.org/terms, and your continued use of our services signifies your acceptance of any such changes. For material changes affecting SMS communications, we will notify you via text message or email.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the State of South Carolina, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved through good faith negotiations. If negotiations fail, disputes will be subject to the exclusive jurisdiction of the courts in Columbia, South Carolina.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Children's Privacy

Our services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected information from a child under 18, we will take steps to delete that information promptly.

16. Entire Agreement
